These terms apply to your use of lvnary.com, run by LVNARY, an independent band based in Morgantown, West Virginia ("LVNARY", "we", "us"). By using the site, you agree to them. If you don't agree, please don't use the site.

Acceptable use

Use the site lawfully and respectfully. Do not:

  • Break the law or infringe anyone's rights while using the site.
  • Try to hack, overload, scrape at scale, or disrupt the site or the services that run it.
  • Sign up other people for our mailing list without their permission.
  • Send us spam, malware, or abusive messages.

Intellectual property

The LVNARY name and logo, our music, lyrics, artwork, photos, videos, text, and the design of this site belong to LVNARY, its members, or the people who licensed them to us. They are protected by copyright and trademark law.

You may view and share links to the site for your own personal, non-commercial use. Anything else, such as reusing our music, photos, or logo, needs our written permission.

If you send us ideas, feedback, or other material, you agree we can use it without owing you anything, unless we agree otherwise in writing.

We respect the rights of other creators. If you believe something on this site infringes your copyright, email a notice to wearelvnary@gmail.com with:

  • Your contact information and signature.
  • A description of the copyrighted work and where the material you believe infringes appears on our site.
  • A statement that you believe in good faith the use is not authorized.
  • A statement, under penalty of perjury, that your notice is accurate and that you own the copyright or are authorized to act for the owner.

The site links to services we don't control, including streaming platforms and social media. We aren't responsible for their content, availability, or practices.

Merch. We sell merch at lvnary.com/merch. Prices are in US dollars and include card processing. Shipping is shown before you pay. Card payments are processed by Stripe; Venmo, Cash App, and Zelle payments are covered by those services' terms.

Orders paid with Venmo, Cash App, or Zelle are held for 3 days. If payment hasn't arrived by then, we may cancel the order. If we can't fill an order, for example because an item sold out at the same moment, we refund what we can't send.

Orders shipped outside the US may owe customs duties or import taxes charged by the destination country. The buyer pays those.

Returns and refunds. If your order arrives damaged, defective, or not what you ordered, email us at wearelvnary@gmail.com within 7 days of delivery with your order number and a photo. We'll send a replacement or refund you, and we cover the postage. If a shirt doesn't fit, you can swap it for another size within 7 days of delivery while that size is in stock. The shirt must be unworn and unwashed, and you pay to mail it back. Stickers and orders without a problem can't be returned. Card refunds go back to your card; Venmo, Cash App, and Zelle refunds go back through the same app.

Show details such as dates, venues, and ticket links may change. Ticket sales are handled by the venue or ticket seller.

Disclaimers

We work to keep the site accurate and available, but it is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't promise the site will be error-free, secure, or always online.

Limitation of liability

To the fullest extent the law allows, LVNARY and its members will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the site. Our total liability for any claim related to the site is limited to $100. Some places don't allow these limits, so they may not all apply to you.

Indemnity

If you misuse the site or break these terms, and that leads to a claim against LVNARY or its members, you agree to cover the reasonable costs of that claim, including legal fees, to the extent the law allows.

Governing law

These terms are governed by the laws of the State of West Virginia and applicable United States law, without regard to conflict-of-law rules. Any dispute will be handled in the state courts located in Monongalia County, West Virginia, or in the United States District Court for the Northern District of West Virginia, unless the law where you live gives you the right to bring a claim elsewhere.

Termination

We may change, suspend, or stop the site, or block access for anyone who breaks these terms, at any time. Sections that by their nature should continue, such as intellectual property, disclaimers, and limitation of liability, still apply afterward.

Changes

We may update these terms. We will post the new version here with a new effective date. Using the site after a change means you accept the updated terms.
